How to Subpoena Witnesses
Before the Grand Jury
The district attorney may issue subpoenas for witnesses within the state to testify before a grand jury in support of the prosecution or for other witnesses as requested by the grand jury.
Issuance of Subpoena
A subpoena must be subscribed by the district attorney and command the witness to appear before the grand jury at a specific time and place.
At Trial
The district attorney may also issue subpoenas for witnesses at trial.
The subpoena must be served on the witness at least 10 days before the trial date.
By the Defendant
A defendant in a criminal case may also issue subpoenas for witnesses.
The subpoena must be served on the witness at least 7 days before the trial date.
